Terms and conditions

DEFINITIONS

Where the context allows the “Company” means Rowan Bank. The “Customer” means the party dealing with the Company. “Goods” and “Services” means respectively all the goods and services the subject matter of the dealing between the Company and the Customer.

GENERAL

The Company contracts with the Customer in accordance with the following terms and conditions. These terms and conditions are deemed to be accepted by the Customer unless express written variations are negotiated which may only be authorised on behalf of the Company by a Director.

 

PRICES

Prices are subject to change without notice at any time prior to the company receiving the Customers order.
The Company reserves the right by giving notice to the Customer at any time before delivery of performance to increase the price of goods and services to reflect any increase in the cost to the company which is due to any factor beyond the control of the company, any change in delivery dates, quantity, scope or specifications for the goods or services which is requested by the Customer or any delay caused by the Customer to give the Company adequate information or instructions.

 

LIABILITY

The Company shall not be liable to the Customer or be deemed to be in breach of contract by reason of any delay in performing or any failure to perform any of the Company’s obligations in relation to the goods and/or services if the delay or failure was due to any cause beyond the Company’s reasonable control.

TERMS OF PAYMENT

The Customer shall pay the price as follows

50% of the project cost is to be paid upon placement of order and is not refundable. The remaining 50% is due upon completion.
Monthly charges are to be paid monthly in advance, on the 1st of the month following completion of the website. One month’s notice is required for cancellation of any monthly arrangement.
Any other work should be paid for upon delivery of the service.

The time of the payment of the price shall be of the essence.

If the customer fails to make the payment on the due date then without prejudice to any right or remedy available to the Company the Company shall be entitled to

Cancel the contract or suspend any further delivery of goods and/or performance of services for the customer under any contract.
Charge the Customer interest on the amount unpaid until payment is made in full
Charge the Customer an administration fee of £50 payable upon demand being a reasonable pre-estimate of the cost to the Company in monitoring payments and following credit control procedures.
Recover from the customer upon demand and on full indemnity basis all legal costs and expenses incurred by the company in seeking to recover the overdue payment
A charge of £15 will be levied to cover the costs incurred on all returned cheques not met on presentation to the Bank.
